Disclosure and request for consent to process personal data Privacy statement pursuant to and for purposes of Article 13, Legislative Decree no. 196 of June 30, 2003

In compliance with Legislative Decree no. 196 of June 30, 2003, (Privacy Consolidation Act), we are providing you with all required information concerning the purposes of and methods for processing your personal data, as well as the scope of communication and dissemination, the type of data in our possession and its provision. Reggiani Spa Illuminazione processes the personal data of users and customers with care. This privacy disclosure establishes the privacy policy of Reggiani Spa Illuminazione; it governs sites within the domain of Reggiani Spa Illuminazione and all related corporate sites of companies which have contractual ties to Reggiani Spa Illuminazione or which are part of its distribution network (such as branch offices, importers, distributors, and so forth), and sites (collectively referred to as “Sites” and separately referred to as a “site”) through which Reggiani Spa Illuminazione collects personal data. When accessing or using any of the aforementioned sites, the user also expressly accepts the privacy conditions established in this policy. If you do not agree with any term in this privacy policy, please do not use the sites or provide your own personal data. It may be necessary to provide personal data to obtain some services. 1 Personal data For the purposes set out in this privacy policy, “Personal Data” shall mean any information through which the user may be personally identified, including but not limited to first and last name, address, land line or mobile telephone number, email address, age, date of birth, gender, profession, product data and details, product preferences, product satisfaction, language, driving experience and related information, photos and stories, etc.

Reggiani Spa Illuminazione’s privacy policy governs the processing of the user’s personal data, including but not limited to the collection, use, storage and protection of the data provided by and/or collected from the user for the purposes indicated below.

Purposes of data processing for which consent is requested ( Art. 23 of Leg. Decree 196/03 )

a) management and processing of data relating to:

  • registration with this website and any information sent to you at your request;
  • requests regarding warranties;
  • activities strictly connected with and critical to customer relationships (e.g. acquisition of data prior to concluding a contract, operations based on obligations arising from contracts with customers, etc.);
  • accounting (issuing invoices, arranging payments) and any transfer of data abroad, including to non-EU countries, within the limits of the law;
  • supply of goods and services and protection of amounts owing as a result of this;
  • information, to formalize requests for information on products, services, preparation of estimates or offers;
  • supply of the services as indicated in the relative contractual conditions, and hence to permit all activities relating to execution of the contractual agreement, to provide required services and to fulfill obligations, and for anonymous statistical surveys;
  • handling of requests for information;

b) to allow Reggiani Spa Illuminazione to conduct market research and for advertising purposes. For these purposes only, Reggiani Spa Illuminazione may communicate your data to associated companies or subsidiaries of Reggiani Spa Illuminazione, and to companies with contractual ties to Reggiani Spa Illuminazione or which are part of its distribution network (such as branch offices, importers, distributors, and so forth), even if their headquarters are in non-European Union countries, and in this case the data will be processed exclusively for:

- promotional communications, whether personalized or not for information such as:

  • determining the level of customer satisfaction by sending advertising leaflets and advertising in hard copy and as emails and SMS and MMS text messages;
  • receiving email communications and advertising circulars;

- the organization of meetings, conventions and similar events;
The user’s personal data will not be utilized for purposes of point b) unless he/she has given prior consent to this. The user has the right to opt for this service at the time the personal data is provided.

Processing Methods – Data Storage

Processing will be carried out in automated and/or manual form, by authorized personnel in compliance with the provisions of articles 31 et seq. of Legislative Decree 196/03, using methods and means that guarantee maximum security and confidentiality. Data will be stored at our headquarters in Viale Monza, 16, Sovico (MI) or at the headquarters of the parent company or third parties indicated from time to time in order to provide the services, for the time strictly necessary for the aforementioned purposes, and for no longer than the time prescribed by law. In compliance with current regulations, specific security measures are taken to prevent the loss of data, unlawful or improper use and unauthorized access. Minors under age 18 may provide personal data only with adult consent – for example a parent or guardian. The user shall hold Reggiani Spa Illuminazione harmless and indemnify it and its affiliates from any injury, loss or harm in general, either personal or to property, arising from the acceptance of or participation in the sites.
For contractual and administrative-accounting purposes, the personal data will be stored solely for the period required to achieve the administrative purposes for which the data was collected and subsequently processed; for marketing purposes, it will be kept for no more than twenty-four months after it was recorded, unless it is actually transformed into anonymous form.

Scope of communication and dissemination

Possibly sensitive personal data will not be disseminated, but Reggiani Spa Illuminazione may communicate it for the aforementioned purposes to Reggiani Spa Illuminazione’s associated companies and/or subsidiaries, or companies which are part of its distribution network (such as branch offices, importers, distributors, and so forth), even if they do not have headquarters in European Union countries, and in this case they will process it solely for the aforementioned purposes. The data may be communicated abroad within the European Union, in compliance with and within the limits of Art. 42 of Legislative Decree no. 196/2003. The personal data may be transferred abroad to non-EU countries within the scope and limits provided by Art. 44 letter b) of Legislative Decree no. 196/2003. The data may be communicated to third parties in the following categories:

  • suppliers of services relating to management of the information system used by Reggiani Spa Illuminazione, and of the telecommunication networks (including email);
  • in-house and/or outsourced parties, in order to file hard copy and/or electronic documents;
  • service companies to acquire, record and process data from documents, or formats provided and generated by customers themselves for mass processing of payments, bills, checks and other instruments;
  • entities that provide customer assistance, including through the Internet (e.g. call centers, help desks etc.);
  • offices or companies which provide assistance or consulting services, including control of company organizational management;
  • companies with contractual ties to Reggiani Spa Illuminazione;
  • entities within Reggiani Spa Illuminazione’s distribution network (such as branch offices, importers, distributors, and so forth);
  • public agencies and administrations for the purposes of audits and controls in compliance with fiscal and civil obligations;
  • banks and credit and insurance institutions to carry out economic (payments/collections) and insurance activities;
  • entities that control, audit or certify activities performed by Reggiani Spa Illuminazione, including on behalf of customers;
  • for the purposes in point b), personal data may be communicated to sales and marketing research companies.

Entities in the aforementioned categories shall act as Data Processors, or shall act independently as distinct Data Controllers. The list of processors is regularly updated and is available at the headquarters of Reggiani Spa Illuminazione.
Your prior express consent will be required for any other communication or dissemination. Personal data which is stored and sent through the Internet is protected by updated, commonly used technological means.

Provision of personal data

Provision of the personal data for the purposes set forth in point a) is optional, i.e. it is not a legal obligation, but it is necessary to be able to conclude and execute the relative contract. Any refusal to consent to processing for the purposes indicated in point a) above will make it impossible to complete your registration on this site and possibly to provide the services themselves, which are necessary to meet contractual, warranty, accounting and fiscal obligations through which Reggiani Spa Illuminazione collects personal data. Any refusal to consent with regard to point a) will make it impossible for Reggiani Spa Illuminazione to respond to requests for information received. The data controller also notes that any failure to provide mandatory data or any provision of inaccurate mandatory data will have the following consequences:

  • it will be impossible for the data controller to guarantee completion of registration with this site, send responses to requests for information and/or guarantee that the processing itself will be consistent with any contractual provisions covering this;
  • the results of the processing may not correspond to obligations imposed by any fiscal, administrative and statutory regulations on which it is based.

If the registration form does not include “mandatory” data, it will not be possible to complete the registration procedure.
Provision of the personal data for the purposes set forth in point b) is optional, i.e. it is not a legal obligation. The only consequence of failing to provide data for these purposes will be to make it impossible for Reggiani Spa Illuminazione and associated companies and/or subsidiaries of Reggiani Spa Illuminazione which are part of the Reggiani Spa Illuminazione group to contact the user for promotional marketing communications, including personalized communications for information.
Refusal to consent for the purposes indicated in point b) will not have any negative consequences on your requests and/or on execution of the relative contract.
You may enforce your rights pursuant to articles 7, 8, 9 and 10 of Legislative Decree no. 196 of June 30, 2003, by contacting the Data Controller (or the Data Processor, if appointed).

Cookies

Cookies are files or bits of information that are filed on the user’s computer hard drive (files sent by the site’s server to the user’s browser) when the user visits the site. The session cookies utilized are designed to speed up the analysis of Internet traffic and facilitate users in accessing the services offered by the site. Most browsers are set up to accept cookies. If you do not want to accept cookies, it is possible to set up your computer to reject them or else notify you when they are filed. If the user refuses to accept cookies, the ability to provide personalized services will be limited. In this case, some functions of the site may not operate correctly, and some of the services may not be available. Cookies cannot and will not be used to capture the email address of persons from whom information is requested, to obtain information from their computer hard drive, or acquire confidential or sensitive information about them. Section 7. Right to Access Personal Data and Other Rights

1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exists, regardless of it being already recorded, and communication of such data in intelligible form. 2. A data subject shall have the right to be informed a) of the source of the personal data; b) of the purposes and methods of the processing; c) of the logic applied to the processing, if the latter is carried out with the help of electronic means; d) of the identification data concerning data controller, data processors and the representative designated as per Section 5 paragraph 2; e) of the entities or categories of entity to whom the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing. 3. A data subject shall have the right to obtain a) updating, rectification or, where interested therein, integration of the data; b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected. 4. A data subject shall have the right to object, in whole or in part, a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection; b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
